These Terms of Use (“Terms”) govern access to and use of guajiron.com (the “Site”), operated by Fun Entertainment Services LLC DBA Guajirón (“Guajirón,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
Site purpose and eligibility
The Site provides general information about Guajirón, including music, videos, public shows, booking, and musician openings. It is not professional advice or a promise that any show, opportunity, service, or feature will remain available. The Site is not directed to children under 13, and they must not submit information or enable tracking. If you are 13 or older but under the legal age of majority where you live, use the Site only with permission from a parent or legal guardian.
Shows, tickets, and third-party venues
Dates, times, locations, lineups, prices, age limits, accessibility, and other show details may change or be incorrect. A show may be postponed or canceled. Confirm important details with the venue or ticket seller before traveling or making a purchase. Unless we expressly state otherwise, Guajirón does not issue tickets and is not responsible for a venue’s or ticket seller’s terms, refunds, admission decisions, safety rules, accessibility, conduct, availability, or acts and omissions.
Booking inquiries
A form submission, email, conversation, estimate, or availability statement is an inquiry only. It does not reserve a date or create a performance, agency, partnership, employment, or other agreement. A booking becomes binding only when the authorized parties enter a separate written agreement and satisfy any stated deposit or other conditions. That agreement controls the engagement and prevails over these Terms if they conflict.
You represent that booking information you provide is accurate, that you are authorized to act for the event or organization you identify, and that you will promptly tell us about material changes.
Musician openings
A musician listing, page visit, email link, reply, conversation, or audition is not an offer or guarantee of employment, membership, an audition, compensation, or an engagement. We may change, pause, fill, or close an opening and may choose whether to respond or proceed. Any relationship requires a separate agreement with the applicable terms.
Mailing list, reminders, and communications
Mailing-list messages and show reminders are conveniences and may be delayed, incomplete, filtered, or not delivered. Do not rely on them as the only source of time-sensitive information. You may unsubscribe from marketing email at any time. When you contact us electronically, you consent to receive an electronic response about that request.
Your submissions
You keep ownership of information and materials you submit. You give us a non-exclusive, worldwide, royalty-free license to host, copy, transmit, review, and use them only as reasonably needed to operate the Site, respond to you, evaluate an inquiry, protect our rights, and maintain related business records.
You represent that your submission is accurate to the best of your knowledge, that you have the right to provide it, and that it does not violate law or another person’s privacy, intellectual-property, publicity, contractual, or other rights. Do not send unlawful, harmful, deceptive, infringing, confidential third-party, or malicious material.
Ownership and permitted use
The Site and its text, photographs, recordings, videos, artwork, arrangements, graphics, logos, design, and software are owned by or licensed to us and are protected by applicable intellectual-property laws. You may view and share links to public pages for personal, noncommercial use. No other license is granted. You may not reproduce, distribute, publicly perform or display, modify, create derivative works from, sell, license, or commercially exploit Site content without permission from the applicable rights holder.
Prohibited use
You may not use the Site to violate law or another person’s rights; impersonate anyone; submit false or unauthorized information; interfere with operation or security; bypass access controls; probe for vulnerabilities; introduce harmful code; harvest personal information; use automated access in a way that burdens the Site; or help another person do any of these things.
Third-party services
The Site may embed or link to venues, ticket sellers, Meta, YouTube, Spotify, social networks, email applications, and other third parties. We do not control and do not endorse every statement, product, or practice of those services. Your use of them is governed by their terms and privacy policies and is at your own risk.
Disclaimers
To the fullest extent permitted by law, the Site and all Site content are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including warranties of accuracy, completeness, availability, security, fitness for a particular purpose, merchantability, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components. Rights and warranties that cannot lawfully be excluded remain unaffected.
Limitation of liability
To the fullest extent permitted by law, Guajirón and Fun Entertainment Services LLC, and their owners, officers, employees, contractors, and agents, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, goodwill, data, or opportunities; or damages arising from access to, reliance on, use of, or inability to use the Site or a linked service.
To the fullest extent permitted by law, our total liability arising from the Site or these Terms will not exceed the greater of the amount you paid us specifically for access to the Site during the twelve months before the claim or US $100. These limits do not apply to liability that applicable law does not allow us to limit, including liability for fraud, willful misconduct, or personal injury caused by negligence where such an exclusion is prohibited.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Fun Entertainment Services LLC and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs, including attorneys’ fees, arising from your unlawful misuse of the Site, your submission, or your material violation of these Terms or another person’s rights.
Governing law and disputes
California law governs these Terms, without regard to conflict-of-law rules. Nothing in these Terms deprives you of a consumer protection that cannot lawfully be waived. Any dispute may be brought in a court of competent jurisdiction as permitted by applicable law.
Changes and general terms
We may suspend or end access to the Site and may update these Terms by posting a revised version with a new effective date. Changes apply prospectively when posted unless law requires additional notice. Continued use after that date means you accept the revised Terms.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer or by operation of law. These Terms are the entire agreement about use of the Site, but do not replace a separate written booking or other agreement. The Privacy Policy is a notice describing our information practices.
